We’re excited to have you here but before you start using REAP Dashboard, we do need you to read through these Terms and accept them by ticking the box as indicated. We’ve done our best to explain our Terms of use without using too much jargon, so it’s clear what we expect from you and what you can expect from us. To make things easier, you can use the navigation menu to find specific sections of the Terms.

These Terms, as updated from time to time, set out our respective rights and obligations in relation to REAP Dashboard, so please do read everything. However, do keep in mind that our Terms do not apply retrospectively, so when our Terms are updated, the updated version will apply from the date of update onwards. If you don’t agree to our Terms, then you can’t use our Services. Joining and using REAP Dashboard

In this section we explain how to subscribe to REAP Dashboard and use our Services.

1. You and REAP Dashboard:

REAP Dashboard is a trading name for Auldskool Unit Trust ABN 66 471 837 865.

When we say you or your, we mean both you and any entity or firm you’re authorised to represent. When we say REAP Dashboard, we, our or us, we’re talking about the REAP Dashboard entity you contract with and pay fees to based on the edition of the REAP Dashboard product you’re using.

2. Our Services:

Our Services consist of all the Services we provide now or in the future, including our online and mobile accounting and financial products.

3. Creating a subscription:

When you create a subscription to use our Services and accept these Terms, you become a subscriber. If you’re the subscriber, you’re the one responsible for paying for your subscription.

4. People invited to use REAP Dashboard:

An invited user is a person other than the subscriber who has been invited to use our Services through a subscription. If you’re an invited user, you must also accept these Terms to use our Services by ticking the box as indicated.

5. User roles and access:

As noted above, a user is the person who accesses REAP Dashboard Services through a subscription. Every organization has at least one user. If additional users are requested, the request must be made in writing to REAP Dashboard via support@reapdashboard.com, once granted and set up this additional user will have the same permissions as the primary user.

6. The right to use our Services:

Whether you’re a subscriber or an invited user, we grant you the right to use our Services (based on your subscription type, your user role and the level of access you’ve been granted) for as long as the subscriber continues to pay for the subscription, until the subscription is terminated, or – if you’re an invited user – until your access changes or is stopped.

7. Subscriber role:

As a subscriber, you take responsibility for fully controlling how your subscription is managed and who can access it. It’s quite a big deal! For example: You can transfer a subscription and you control access to a subscription. You decide who’s invited to use our Services you’ve subscribed to and what kind of access the invited user has. You can change or stop that access at any time. You’re responsible for resolving any disputes with any invited users over access to your subscription. You’re responsible for all your invited users’ activity and use of the Services.

8. Rules:

Whatever your role is, when you use REAP Dashboard you agree to follow the rules outlined here. Please read them and make sure you understand what you should and shouldn’t do.

9. Your responsibilities:

You promise that you’ll keep your information (including a current email address) up to date. You’re responsible for providing true, accurate and complete information and for verifying the accuracy of any information that you use from our Services for your legal, tax, compliance, and any other obligations. You’re also responsible for protecting your username and password from getting stolen or misused. The stronger the password the better! For more on security generally, check out our security section below at clauses 24 – 26.

10. When we introduce new or revised Services:

Since we’re always thinking about how to make REAP Dashboard the best it can be –we regularly expand our Services. For new or updated Services, there might be additional Terms. We’ll let you know what those Terms are before we start providing those Services.

11. What we own:

We own all content in our services unless otherwise stated. This includes all intellectual property rights. Using, copying, publishing, storing, distributing, modifying, or creating derivative works from our content or intellectual property is prohibited, except as expressly permitted in writing.

12. REAP Dashboard pricing plans:

Your use of our Services is subject to a payment pricing plan that requires you to pay a monthly subscription fee based on your subscription type (the subscription fee). The pricing plan consists of the subscription and subscription fees we offered you, including invoicing, payment, auto-renewal, and cancellation Terms. The pricing plan may vary by region and includes information set out in the offer details and pricing page. We may update or amend the pricing plan from time to time. The Terms of the pricing plan form part of these Terms. As with any other changes to our Terms, changes to the pricing plan won’t apply retrospectively.

13. Taxes for your use of our Services:

You’re responsible for paying all other external fees and taxes associated with your use of our Services wherever levied. Your responsibility includes withholding tax if it applies, unless we already process that withholding tax. We may collect geographical location information to determine your location, which may be used for tax purposes. This means location information you give us must be accurate for tax residency purposes.

14. Importance of timely payments:

In order to continue accessing our Services, you need to make timely payments based on the pricing plan you selected. To avoid delayed or missed payments, please make sure we have accurate payment information. If we don’t receive timely payments, we may suspend access to your subscription until the payment is made.

15. Use of data:

When you enter or upload your data into our Services, we don’t own that data but you grant us a licence to use, copy, transmit, store, analyse, and back up all data you submit to us through our Services, including personal data of yourself and others, to: enable you to use our Services; allow us to improve, develop and protect our Services; create new Services; communicate with you about your subscription; and send you information we think may be of interest to you based on your marketing preferences.

16. Use of your own personal data:

We respect your privacy and take data protection seriously. In addition to these Terms, our privacy notice sets out in detail how we process your own personal data that you enter into REAP Dashboard, like your name and email address. Please refer to our privacy notice for further information.

17. Use of personal data you enter about others:

Depending on where your contacts are based, our data processing Terms may also apply to the personal data of others (such as your customers, suppliers, and employees) that you enter into REAP Dashboard. In the case of third-party data, you warrant that you are properly authorised to submit that data to us in compliance with all applicable laws.

18. Anonymised statistical data:

When you use our Services, we may create anonymised statistical data from your data and usage of our Services, including through aggregation. Once anonymised, we may use it for our own purposes, such as to provide and improve our Services, to develop new Services or product offerings, to identify business trends, and for other uses we communicate to you.

19. Data breach notifications:

Where we think there has been unauthorised access to personal data inside your subscription, we’ll let you know and give you information about what has happened. Depending on the nature of the unauthorised access, and the location of your affected contacts, you may be required to assess whether the unauthorised access must be reported to the contact and/or a relevant authority. We think you’re best placed to make this decision, because you’ll have the most knowledge about the personal data stored in your subscription. It will therefore be your responsibility to report any unauthorised access to any of your affected contacts.

20. Keeping it confidential:

While using our Services, you may share confidential information with us, and you may become aware of confidential information about us. You and we both agree to take reasonable steps to protect the other party’s confidential information from being accessed by unauthorised individuals. You or we may share each other’s confidential information with legal or regulatory authorities if required to do so.

21. Security safeguards:

Platform Configuration
The REAP Dashboard Platform is set with a highly available configuration of the database using cloud native Services from a Global Public Cloud provider. The many benefits include;
• High Availability of the Platform – above 99.9%
• System updates and security are automatically provided
• Seamless scalability of the platform if demand for the platform requires
• Key features such as defence against a Distributed Denial-of-Service (DDoS) attack and Global Load Balancing are deign in.

All data held upon the REAP Dashboard Platform is automatically configured to back up every 24 hours.

Data Sovereignty
All centralised data for the REAP Dashboard Platform is stored within New South Wales, Australia.

In order to provide end to end security from your end point device to the REAP Dashboard Platform, Transport Layer Security (TLS) protocols are utilized. TLS, provides cryptographic protocols designed to provide communications security over a computer network. In this case data across the Internet from the web browser using REAP Dashboard to the Platform Application Services on the Cloud will be encrypted.

Maintenance or security configuration changes
In some circumstances REAP Dashboard will need to be taken offline to conduct maintenance or security configuration changes. In this case REAP Dashboard administration will be in contact to inform you of the outage period.

22. Additional account security features:

We may introduce additional security features to make your account even more secure, such as two-step authentication. Depending on where you are in the world or what Services you’re using, we may require you to adopt some of these features. Where we make the use of security features optional, you’re responsible (meaning we’re not liable) for any consequences of not using those features. We strongly encourage you to use all optional security features.

23. Playing your part to secure your data:

You have an important part to play in securing your data and the data of others by keeping your login details secure, not letting any other person use them, and by making sure you have strong security on your own systems. If you realise there’s been any unauthorised use of your password or any breach of security to your account or email address linked to your account, you need to let us know immediately. You also agree not to use free-form fields in any of REAP Dashboard’s systems or Services to store personal data (unless it’s a field explicitly asking for personal data – like a first name or a last name), credit card details, tax identifiers or bank account details.

24. Payments to REAP Dashboard:

Just so you know, some third-party providers may pay REAP Dashboard a fee that may be related to: referrals from REAP Dashboard; revenue made by the provider; or data that the providers access about you through our Services with your consent. One example would be you applying for a loan with a third-party lender using your REAP Dashboard data.

25. Disruption, access issues and data loss:

We really try to minimise the possibility of any disruption to or access issues with the Services, but we can’t guarantee that disruptions and access issues caused by matters such as internet connections won’t occur. You know how the internet works, there may be disruptions or access issues for any number of reasons, at any time. In those cases, you may experience data loss, so backing up your data is important. Data loss is an unavoidable risk when using any technology so please be aware that. you’re responsible for maintaining copies of your data entered into our Services.

26. Maintenance and availability:

We strive to maintain the availability of our Services. However, on occasion, we need to perform maintenance on our Services (such as when it’s necessary so we can keep our Services updated and secure), and this may also result in a period of downtime. We try to minimise any such downtime. Where planned maintenance is being undertaken, we’ll attempt to notify you in advance but can’t guarantee it.

27. No compensation:

Whatever the cause of any downtime, disruption, access issues or data loss, your only recourse is to discontinue using our Services. We take no responsibility for any loss, damage or injury which may have been caused to you or any third party by any downtime, disruption, access issues or data loss and we will not be liable for any claim for compensation or other remedy from us.

28. Problems and support:

If you have a problem, you can contact our support team at any time by going to https://www.reapdashboard.com and selecting the “contact us” menu option. We will endeavour to get back to you within 24 hours or as reasonably practicable.

29. Feedback:

We love your feedback and may use it without restriction at any time. You can provide feedback to us by going to https://www.reapdashboard.com and selecting the “contact us” menu option.

30. Help using our Services:

We provide limited guidance and support to help you use our Services. You must only use our Services for lawful business purposes and in line with the instructions and guidance we provide.

31. Data limitation:

Some of our Services may be subject to limits such as a cap on the number of monthly transactions.

32. While we can’t cover everything here, we do want to highlight a few more examples of things you mustn’t ever do:

• Undermine the security or integrity of our computing systems or networks.
• Use our Services in any way that might impair functionality or interfere with other people’s use.
• Access any system without permission.
• Introduce or upload anything to our Services that includes viruses or other malicious code.
• Share anything that may be offensive, violates any law, or infringes on the rights of others.
• Modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer, or extract the source code of any part of our Services.
• Resell, lease, or provide our Services in any way not expressly permitted by these Terms of use.
• Repackage, resell, or sublicense any leads or data accessed through our Services.
• Commit fraud or other illegal acts through our Services.
• Act in a manner that is abusive or disrespectful to a REAP Dashboard employee, partner, or other REAP Dashboard customer. We will not tolerate any abuse or bullying of our REAP Dashboard employees in any situation and that includes interaction with our support teams.

33. Termination:

Unless we choose at our discretion to immediately terminate your subscription on account of you breaching these Terms (including your ability to meet your payment obligations under your payment pricing plan) your subscription will continue for the duration of your payment pricing plan which will be 12 months.

34. Cancellation:

Subscription cancellation requests must be submitted at least 30 days before the first anniversary date. Failure to do so will result in an automatic renewal of your subscription for the subsequent 12 months.

35. Disclaimer:

While we make every effort to ensure that in providing Services, we also provide accurate information which is up to date, it may be that some information is not totally accurate or up to date. We do not warrant the quality, accuracy and completeness of any information provided as part of the Services. We will not be liable for your, or any other party’s use of or reliance on any information or materials provided as part of the Services, which you and any other party use at your own risk. It is your responsibility to make sure that any information or material provided as part of the Services meets your specific requirements.

For the avoidance of doubt, this disclaimer applies to information we provide as well as information you have provided to us (which may be financial or non-financial information about your business) and which then becomes available to you via the REAP Dashboard. This is because, as noted in clause 9, you are responsible for providing true, accurate and complete information about your business when you use our Services and for verifying the accuracy of any information that you use from our Services, which includes any information that has been provided about your business.

36. Limitation:

Where we are required by law to offer any warranty in respect of the information or materials provided as part of the Services, to the maximum extent possible, our liability for breach of such warranty is limited at our absolute discretion to either: (a) the re-supply of the information and/or materials, or (b) to payment for the information to be re-supplied.

37. Jurisdiction:

These Terms are governed by the laws of the State of New South Wales. Any claim, dispute or other matter arising from these Terms which needs to be dealt with by a court must be dealt with by a court of competent jurisdiction located in Sydney, New South Wales.
